Reference is made to eBay UserAgreement of eBay Inc., 2025 Hamilton Ave., San Jose, CA 95125 . The inclusionof the Client`s own conditions is herewith objected to, unless other terms havebeen stipulated. 2) Conclusion of the Contract2.1 The product descriptions presented by the Seller on theeBay trading platform do not constitute binding offers on the part of theSeller, but merely serve the purpose of submitting a binding offer by theClient.2.2 The Client can place an order via the eBay tradingplatform. By completing his personal data and clicking the "submitorder" in the final stage of the ordering procedure the Client's order isdeemed to be a legally binding offer to buy the chosen amount of goods relatedto the goods displayed in the online shopping basket.2.2.1 The Seller can acknowledge receipt of the Client’sorder by sending him an automatically generated e-mail acknowledging his order.Such an acknowledgement of receipt is no acceptance of the Client’s order. TheSeller can accept the Client’s offer by sending him a letter or a separatee-mail or a fax accepting the order or by delivering the goods within fivedays. With this separate confirmation, the contract will be concluded. TheSeller has no obligation to accept the Client’s offer.2.2.2 The contract’s content will be stored by the Sellerand will be sent to the Client in writing including these Terms and Conditionsand Client Information (for example via e-mail, fax or letter) after the Clienthas submitted his order. In addition, the contract’s content will be stored byEbay and can be found free of charge by the Client indicating the respectiveitem number under www.ebay.com, within 90 days after conclusion of thecontract. If the client wants to find the product description site, he has toenter the respective item number in the search box of the eBay home page andhas to click on the button "find”.2.3 The Client can correct all the data entered via theusual keyboard and mouse function prior to submitting his binding order. Inaddition, prior to submitting the order, all data entered will be displayed ina confirmation window and can be corrected here as well, via the usual keyboardand mouse function. 3) Return policyThe Seller offers 30 days return policy from the day theClient received the item. Refunds will only be made after the Client hasreturned the item to the Seller’s address within 20 days of receiving themerchandise. The Client pays the return shipping costs to the Seller’s address. 4) Price and delivery costs4.1 Prices are indicated in US dollars excluding taxes.Shipping costs for standard shipping are not charged.4.2 Shipping costs for shipping methods other than standardshipping are specified separately in the respective product description.4.3 For deliveries to the United States, additional costsmay arise such as transfer fees charged by the bank and taxes and/or customsduties. Those costs have to be borne by the Client.4.4 Payment can be made using one of the methods mentionedby the Seller on the eBay trading platform. If payment in advance is agreed, payment is due immediately after conclusion of the contract. 5) Shipment and Delivery Conditions5.1 Delivery of goods shall be made on the dispatch route tothe delivery address indicated by the Client, unless otherwise agreed upon. Thedelivery time is specified on the Seller’s order detail page.5.2 Should delivery to the Client not be possible, theassigned transport company returns the goods to the Seller and the Client bearsthe cost for the unsuccessful dispatch. 6) eBay money back guarantee policyRegarding defective goods or goods not delivered ordelivered goods, which do not match the listing description, the eBay moneyback guarantee policy will apply. All defective merchandise may be returnedback to the Seller’s address within 14 days of receipt. Misused or abusedmerchandise will not be accounted as defective. 7) Law and jurisdictionThe Federal Arbitration Act, applicable federal law, and thelaws of the state of Utah, without regard to principles of conflict of laws, will govern these General Terms and Conditions and any dispute of any sort thatmight arise between the parties. 8) Privacy policy8.1 Personal data will only be collected if the Clientprovides this information on his accord for the processing of a contract orwhen registering for a newsletter. Those data will only be used for theprocessing of a contract and for Client’s inquiries.8.2 The Client’s e-mail will be used solely for ownadvertising purposes, if he has expressly consented in this regard. The Clientcan withdraw his consent vis-à-vis the Seller at any time.8.3 In the framework of contract processing the Client’spersonal data will be transferred to the transport enterprise in charge ofdelivery, as far as this is necessary for delivering the goods.8.4 After full implementation of the contract and completepurchase price payment the Client’s data will be stored on account of thepreservation period in accordance with tax and commerce laws. Upon expiry ofsuch period those data will be deleted, unless the Client has expresslyconsented to the further use of his data.8.5 The Client has a right to get information free of chargeabout his stored data and, if he so wishes, he has the right to correction, blocking or deletion of those data. For questions regarding the collection, processing or use of his personal data he can turn to the Seller, free ofcharge.
