He was commissioned a brigadier generalin the Missouri State Militiain 1861, commanding federal forces in northeast Missouri.On January 17, 1862 Henderson was appointed to the U.S. Senate as aUnionist to fill the vacancy caused by the expulsion of TrustenPolk. Later that year, Henderson was elected to a full six-yearterm in the U.S. Senate.The Kingdom of CallawayIn 1862 Henderson signed a peace treaty with JeffersonJones of the short-lived Kingdom of Callaway, lending that breakaway state legitimacy before federal troops invaded and endedits existence.Apocryphal Story about a Meeting withLincolnAccording to a story circulated in the early 1900s, Henderson met with PresidentAbraham Lincoln on April 14, 1865 shortly before Lincoln left for Ford'sTheatre where he was assassinated that night, andsuccessfully procured a pardon for Missouri resident George S. E. Vaughnwho had been convicted of spying and sentenced to death, becoming Lincoln'slast official act as President. However in 2011 David Blanchetteof the Abraham LincolnPresidential Library and Museum in Springfield, Illinoissaid there is no record of any such pardon.13th AmendmentAs a United States Senator representing a slavestate, Henderson co-authored and co-sponsored the ThirteenthAmendment to the United States Constitution permanentlyprohibiting slavery in the United States. Henderson's original proposal, madeJanuary 11, 1864 was submitted to the Senate Judiciary Committee, and onFebruary 10, 1864 it presented the Senate with a proposal combining the draftsof congressmen James Mitchell Ashley(Republican, Ohio), James Falconer Wilson, (Republican, Iowa), CharlesSumner (Republican, Massachusetts), and Henderson.On January 31, 1865 the 13th Amendment was approved by the U.S. Congress, and on February 1, 1865 it was signed by President AbrahamLincoln. On April 14-15, 1865 Lincoln was assassinatedbefore the amendment was ratified by the State of Georgiaon December 6, 1865.While in the Senate, Henderson was chairman of the Committee to Audit andControl the Contingent Expense (Thirty-ninth Congress) and a member of theCommittee on Indian Affairs (Thirty-ninth and Fortieth Congresses).During President AndrewJohnson's impeachment trial, Henderson broke party ranks, along with six other Republican senators and votedfor acquittal. These seven Republican senators were disturbed by how theproceedings had been manipulated in order to give a one-sided presentation ofthe evidence. Senators William Pitt Fessenden, Joseph S. Fowler, James W. Grimes, John B.Henderson, Lyman Trumbull, Peter G. Van Winkle, and Edmund G. Ross of Kansas, who providedthe decisive vote, defied their party and public opinion and voted againstimpeachment. After the trial, Ben Butler conducted hearings on the widespreadreports that Republican senators had been bribed to vote for Johnson's acquittal.In Butler's hearings, and in subsequent inquiries, there was increasingevidence that some acquittal votes were acquired by promises of patronage jobsand cash cards.Henderson was not a candidate for reelection to the Senate in 1868 andleft the U.S. Senate on March 4, 1869.Henderson was an unsuccessful candidate for Governor of Missouriand later U.S. Senator.
