This is a wonderful, original document dated 1701, being an appeal by Seth Pope of Dartmouth for a judgement against him by Major Benjamin Church. Pope has filed a recognizancebond to ensure his appearance before the court...signed by John Cary at bottom right. Document is 8x12, toned on left edge, overall good condition.  John Cary, son of John, b. Nov. 4, 1645; m. Abigail, dau. of Samuel Allen and his second wife, Margaret (French) (Lamb), at Bridgewater, Dec. 7, 1670. In 1680 h...e removed to Bristol, where he resided till his death in 1721. The deed to his land in Bristol was granted Sept. 14, 1680, and confirmed by the General Court, Sept. 29, 1680. The first meeting of the people and the naming of the town was Sept. 1, 1681, and John Cary and his brother David were present. He became a prominent man in the town, and was elected a Deacon of the church at its organization, and held the office till his death. He was one of the first "raters" of the town, and appointed Nov. 10, 1681; in 1693 was recording officer of the County, and Clerk of the peace; in 1694 was Representative to the General Court. His wife was also of good family; her father, Samuel Allen, came from Bridgewater, Eng., to Braintree in 1630; in 1635 he took the oath of allegiance, and was Town Clerk, Selectman, Surveyor of highways, Constable, and served as Deputy three times. He and his son Samuel, who settled in Bridgewater in 1660, both fought in King Philip's War. For eight generations this family has been identified with the best political and religious life of New England. He d. July 14, 1721, his estate amounting to 700 pounds; the will of his wife was recorded in 1729. Captain Seth Pope (1648-1727) was appointed to Justice of Peace by Governor William Phipps, May 27, 1692, and his commission was renewed by Governor Joseph Dudley, Nov. 8, 1707; it was also renewed on Jan. 25, 1709, and Dec. 10, 1715, his last appointment to that office being by Governor Samuel Shute on Nov. 12, 1717.He was  elected a selectman of Dartmouth in the years 1699, 1702, and 1705.Seth Pope did not confine his ventures in business to the land.  He owned shares in various vessels which carried on a profitable coastwise trade.  In 1693 he owned a part of the sloop 'Hopewell', which was commanded by his son, Thomas in 1702, and in 1709 was part owner of the sloop 'Joann and Thankful'.Benjamin Church (c. 1639 – January 17, 1718) was an English colonist in North America. He was a military leader of the historic predecessor of the United States Army Rangers,  captain of the first Ranger force in America (1676).Church was commissioned by Josiah Winslow, the Governor of the Plymouth Colony, to form the first ranger company for King Philip's War. He later commanded the company to raid Acadia during King William's and Queen Anne's wars in the early 1700s, as French and English hostilities played out in North America. The two powers were competing for control in colonial territories.
